Liability release and assumption of risk
I acknowledge that participation in fishing charters, sightseeing tours and any related on-water activities (collectively, the "Activities") operated by Outdoor Adventures BC ("the Operator") involves inherent and unavoidable risks including but not limited to: drowning, cold-water immersion, slips, falls, collision, equipment failure, weather, wildlife encounters, and injury from fishing hooks, lines and tackle.
Assumption of risk
I voluntarily choose to participate in the Activities and accept all risks associated with participation. I confirm I am in adequate physical condition and have disclosed any condition that could affect my safety.
Release of liability
To the maximum extent permitted by law in British Columbia, Canada, I release, waive and discharge the Operator, its owners, employees, agents and contractors from any and all claims, demands, losses, damages, costs and expenses of any kind arising out of or related to the Activities, except where caused by gross negligence or wilful misconduct of the Operator.
Captain's authority
I agree that the Captain has absolute authority regarding safety, weather, route and conduct onboard. I agree to follow all instructions given by the Captain and to wear a personal flotation device when directed.
Media consent
I consent to the Operator photographing and filming the Activities for marketing and social-media use unless I opt out in writing at the time of the trip.
Minors
If I am signing on behalf of a minor, I represent that I am the minor's parent or legal guardian with authority to sign, and that the release above applies to the minor on the same terms.
Governing law
This agreement is governed by the laws of British Columbia, Canada. Any dispute will be resolved in the courts of British Columbia.
